Terms of Service

01Who we are

These Terms of Service (“Terms”) govern your use of spectralwork.com (the “Site”) and of the software, plugins and related services we offer (together, the “Services”). The Services are provided by SPECTRALWORK LLC, a limited liability company organized in New Jersey, United States, trading as SPECTRALWORK (“we”, “us”). When you use the Services or buy from us, your agreement is with SPECTRALWORK LLC.

02Accepting these Terms

By accessing or using the Site or the Services, you agree to these Terms. If you do not agree, please do not use them. If you use the Services on behalf of an organization, you confirm you are authorized to accept these Terms for it.

03Orders and payment

When you buy from us, you buy from SPECTRALWORK LLC. Our checkout is run on Shopify, and payments are processed by Shopify Payments and the payment methods shown at checkout (such as cards, Shop Pay, Apple Pay, Google Pay and PayPal). We never see your full card details.

Prices are shown on the Site and at checkout. Any sales tax or VAT that applies to your location is calculated and shown at checkout before you pay, so the final price may vary by location. Payment is taken in full when you order.

Your order is complete once the payment succeeds. You then receive an order confirmation, and we email your license key and download link to the address you gave at checkout, so please make sure it is correct. If a price on the Site or at checkout is obviously wrong, we may cancel the order and refund it in full, or offer it to you again at the correct price.

Our refund policy is in section 4.

04All sales are final

Our products are digital software delivered immediately, and they come with a free 7-day trial so you can try them in your own projects before you buy. For that reason, all sales are final and non-refundable, except where the law requires a refund, for example a defect we can’t fix within a reasonable time. If you’re accidentally charged twice for the same order, we’ll refund the duplicate.

If something isn’t working, contact us at support@spectralwork.com first: most problems are solved with an update or by reactivating your license.

Customers in the EU and UK. Consumers there normally have a 14-day right to cancel online purchases. For digital content supplied immediately, that right ends once delivery begins, if you expressly agree to immediate delivery and acknowledge that you lose the right. We ask for this consent when you place your order; if you would rather keep the right, please don’t complete the purchase.

Chargebacks. Please contact us before disputing a charge with your bank. If a charge is reversed, the license for that order is deactivated, and we may contest disputes we believe are unjustified using our order and license records.

Nothing in this section limits any rights you have under the consumer laws of your country that cannot be excluded.

05Delivery, activation and free trial

Delivery is digital and immediate: after payment you receive your license key and a download link by email. Each license can be activated on the number of computers stated at purchase, and you can move it between your own computers by deactivating it on one before activating it on another.

The software checks its license with our server when you activate it and from time to time after that. It keeps working offline for up to 30 days between checks; after that, connect to the internet once to continue.

Where we offer a free trial, you can use the full product for 7 days to try it in your own projects. When the trial ends, the software passes audio through unprocessed until you enter a license key. Nothing is charged for a trial and nothing renews from it.

06Software license

When you buy one of our products, we grant you a personal, non-exclusive, non-transferable license to install and use that software for creating your own work, on the number of computers allowed by its license, for as long as you comply with these Terms. The software is licensed, not sold; we and our licensors keep all ownership rights.

You may not:

  • copy, share, resell, rent, sublicense or distribute the software or your license key;
  • reverse engineer, decompile or disassemble the software, except where the law expressly allows it;
  • remove, bypass or tamper with its licensing or copy protection;
  • use the software to build a competing product.

07Updates and support

Updates we release for the version you bought are free and available from us. Support is by email at support@spectralwork.com; include the email address you bought with and we’ll get back to you as soon as we can. We may end support for an old version after a reasonable time.

08Your audio and your work

You own the audio, projects and other material you put through our software, and the sounds and music you make with it. We claim no rights in your inputs or outputs. You are responsible for having the rights to any material you process, and for how you use the results.

If you believe content on the Site infringes your intellectual property, email support@spectralwork.com with details of the work and where it appears, and we will review and remove it where appropriate. We may suspend or terminate the accounts and licenses of users who repeatedly infringe others’ rights.

09Acceptable use

You agree not to use the Site or the Services to:

  • break any law or regulation, or help anyone else do so;
  • commit fraud, send spam, or impersonate any person or organization;
  • infringe anyone’s intellectual property or other rights;
  • interfere with security: upload malware, probe or attack our systems, scrape the Site, or try to gain unauthorized access.

10Our intellectual property

The Site, the Services, our software, the SPECTRALWORK name, logos, sounds and designs are owned by SPECTRALWORK LLC or our licensors and protected by intellectual property laws. Apart from the license above, these Terms give you no rights in them.

11Availability and changes

We work hard to keep the Site and the Services running well, but we do not guarantee they will be uninterrupted, error-free or compatible with every system. We may update, change or discontinue features at any time.

12Suspension and termination

We may suspend or terminate your access to the Services, or your license, if you materially breach these Terms, if payment is not made or is reversed, if we reasonably suspect fraud or a security risk, or for repeated or serious violations. You may stop using the Services at any time.

13Disclaimer and limitation of liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied. Back up your work: we are not responsible for lost projects, data or audio.

To the fullest extent permitted by law, SPECTRALWORK LLC will not be liable for indirect, incidental, special or consequential damages, or lost profits, and our total liability for any claim relating to the Services is limited to the amount you paid us for the product concerned in the twelve months before the claim. Nothing in these Terms limits rights you have under consumer law that cannot be waived.

14Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules, except where the consumer laws of your country of residence give you the right to rely on them.

15Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when they last changed. The version in force when you placed an order applies to that order; continuing to use the Services after a change means you accept the updated Terms for future use.

Privacy Policy

01Who is responsible for your data

SPECTRALWORK LLC (“SPECTRALWORK”, “we”, “us”), a limited liability company organized in New Jersey, United States, is the controller of the personal data described in this policy, which covers spectralwork.com and our software and services.

SPECTRALWORK LLC971 US Highway 202N, Ste RBranchburg, NJ 08876USA

For any privacy question or request, contact us at support@spectralwork.com.

02What we collect and why

  • Contact form — your name, email address, topic and message, so we can reply to you. Legal basis: our legitimate interest in answering your enquiry, or taking steps at your request before a contract.
  • Launch list — your email address, if you sign up to hear when a product launches, so we can email you about it. Every such email has a one-click unsubscribe link. Legal basis: your consent, which you can withdraw at any time by unsubscribing.
  • Purchases and licenses — when you buy, our checkout provider Shopify and its payment processors collect your name, email address, billing address, phone number (if you give one) and payment details to take the payment and prevent fraud. We receive your name, email address, billing address, country, order details and the license issued to you, so we can deliver your product, keep your license working, calculate taxes, prevent fraud and support you. We never see your full card details. Legal basis: performance of our contract with you, our legitimate interest in preventing fraud, and legal obligations such as tax and accounting records.
  • Order and license emails — we email your license key, download link and messages about your purchase to the address you bought with. Legal basis: performance of our contract with you.
  • License activation — to stop licenses being copied, our software contacts our license server when you activate or deactivate it and from time to time after that. It sends your license key, an identifier derived from your computer’s hardware (a one-way code that means nothing outside our server), your computer’s name, and the product and version; our server also sees the IP address of the request. A small encrypted license file is stored on your computer. This lets you move a license between your own computers and keeps it working offline. Legal basis: performance of our contract with you, and our legitimate interest in protecting our software.
  • Support — if you email us, we keep the conversation so we can help you and refer back to it if the issue comes up again. Legal basis: our legitimate interest in helping you.
  • Technical data — like most websites, our hosting provider processes your IP address, browser and device information and request logs to deliver the site and keep it secure. Legal basis: our legitimate interest in running a secure, working website.

03Cookies and local storage

We do not use advertising or tracking cookies. The site stores a few small preferences in your browser’s local storage — such as your light/dark choice and whether you’ve already seen the intro — which never leave your device. If we add analytics or advertising tools in future, we will update this policy and ask for your consent where the law requires it.

04Who we share it with

We do not sell your personal data for money. We share it only with:

  • Shopify, which runs our store and checkout and processes payments (with its payment partners), and uses cookies on its checkout pages that are needed for checkout and fraud prevention. Shopify may also use information about your purchase for its own purposes such as Shop Pay and fraud prevention. For these uses Shopify is responsible itself, under its Consumer Privacy Policy, and you can exercise your rights with it through the Shopify Privacy Portal;
  • service providers that run our infrastructure on our behalf — website hosting, domain and network services, email delivery, and our license server;
  • professional advisers such as accountants and lawyers, where needed;
  • a buyer or successor, if our business is merged, sold or restructured, who must continue to protect it under this policy;
  • authorities, where the law requires us to, and others where needed to protect our rights, our users or the public.

Some of these providers process data outside your country, including in the United States. Where data leaves the EU, EEA or UK, transfers are protected by recognized safeguards such as the European Commission’s standard contractual clauses or the UK’s equivalent, unless the destination is recognized as giving adequate protection.

Our links to Instagram, YouTube, X, Facebook and Discord take you to those services, whose own privacy policies apply there.

05How long we keep it

Order records: as long as tax and accounting law requires (typically up to seven years). Licenses and activations: for as long as the license exists. Launch-list addresses: until you unsubscribe, after which we keep only the fact that you unsubscribed so we don’t email you again. Support and contact emails: up to two years after the last message. Hosting logs: a few weeks. We then delete or anonymize the data.

06Your rights

Depending on where you live, you may have the right to access the personal data we hold about you, correct it, delete it, restrict or object to how we use it, receive a copy of it, and withdraw consent at any time. To use any of these rights, email support@spectralwork.com; we will respond within one month, or sooner where the law requires.

We may need to verify your identity before acting on a request, and you may ask an authorized agent to make a request for you if you give them written permission. We will never treat you differently for using your rights. If we decline a request, you can ask us to reconsider by replying to our answer, and residents of the EU, UK and some US states can also complain to their data protection authority.

To opt out of your data being used for targeted advertising through Shopify, use Shopify’s data sharing opt-out page or the Shopify Privacy Portal linked above, or email us. If your browser sends a Global Privacy Control signal, we treat it as an opt-out request where the law requires.

07Security

We use reasonable technical and organizational measures to protect your data, including encrypted connections (HTTPS) and limiting access to people and providers who need it. No method of transmission or storage is completely secure, but we work to protect your information.

08Children

Our site and products are not directed at children under 13 (or under 16 in the EU), and we do not knowingly collect their personal data. We do not knowingly sell or share the personal data of anyone under 16. If you believe a child has given us personal data, email support@spectralwork.com and we will delete it.

09Changes to this policy

We may update this policy from time to time, for example when our practices or the law change. The “Last updated” date above shows when it last changed, and we will give notice of significant changes where the law requires.
